Courts may ignore or override any clause that improperly limits children’s rights.

4. Making the Agreement Enforceable (“Bulletproof”)

  • Written and properly signed
    The agreement must be in writing, signed by both parties, and properly witnessed.
  • No pressure or duress
    The agreement should be signed well in advance of a wedding or major life event. Signing a prenup days—or hours—before a wedding may be seen as unfair pressure.
